Scientia – Education & Learning Consulting

TERMS AND CONDITIONS

These terms and conditions govern the use of our services. By using our services, you accept these terms and conditions in full.

TERMS

1. “Scientia Education.” Scientia Education is registered in Switzerland. The company registration number is CHE-280.569.590.
2. “Client.” The person(s) who request and pay for services. This is assumed to be the signatory of this document.
3. “Student.” The person who receives the services from Scientia Education.
4. “Tutor.” The person who is delegated by Scientia Education to provide the services.
5. “Lesson.” The provision of services to the Student, billed by Scientia Education.
6. “Services” In person and/or online lessons and/or provision of guidance on submitted work.

CONDITIONS

1. Fees and Payment
Scientia Education shall invoice the Client for its services at appropriate intervals, generally each month or following a pre-payment plan.
Services may include in person lessons, online lessons, and/or the provision of guidance on works the student has submitted to the Tutor, outside of lesson times. The fees for services will be agreed in advance by the Client and Scientia Education. Scientia Education reserves the right to change its rates at any time, provided it gives the Client prior reasonable written notice of any changes.
Payments must be made to Scientia Education by the date specified on the invoice. Interest will be charged on any payment which is outstanding for more than 15 days. Interest will accrue at a rate of 2% per month on all outstanding sums from due date until payment is received.
If the invoice is not paid by the specified date, Scientia Education will pause lessons immediately. Should the invoice remain unpaid for a further week from this time, Scientia Education reserves the right to relinquish the student’s day and time slot with their tutor.
The Client can request an itemised bill for services, the preparation of which will entail a 20 CHF administration fee.

2. Non-solicitation
The Client or Student is not permitted to make private arrangements for services with any Tutor introduced by Scientia Education. Should a Client or Student breach this obligation, they will be liable to Scientia Education for all sums paid to the Tutor, and Scientia Education shall be entitled to obtain an injunction against a Client to prevent further breaches. This obligation shall continue notwithstanding termination of this agreement.

3. Expenses
All expenses for the Tutor are covered by Scientia Education.

4. Liability
Scientia Education is not liable for any direct, indirect, incidental, consequential, special, punitive, or similar damages arising from the use of its services or any errors/omissions in the content of its materials. The Client waives any and all claims arising out of the use of this tutoring service, save for those for which the law excludes the possibility of this waiver.

5. Cancellation Policy
The Client is responsible for finding an agreement with the Tutor for any changes to the tuition timetable. This includes, but is not limited to changes for holidays, illness, and adverse weather conditions that prevent the Student from reaching a lesson. If the Client cancels an individual lesson by giving less than 24-hours’ notice, unless there are mitigating circumstances, the fee for the lesson remains payable in full.
If a Student is not present for his/her lesson within 15 minutes of the start of the lesson, the lesson will be marked as a cancellation (unless the Student informs the Tutor of the delay).

7. Group Classes Cancellation Policy
The usual cancellation policy applies for group classes. Any student may cancel his/her participation in a group class by giving 24-hours’ notice to the Tutor and with all other Students in the group in copy. If the other Students do not wish to cancel the Lesson, the Lesson will be billed to them at the rate corresponding to their number.

8. Assignment feedback
Tutors can read assignments and guide students on techniques to improve the quality of an assignment but cannot write or edit a student’s work.
Reading time and feedback will incur a fee for time spent reading and giving feedback charged at the usual hourly rate. Requests for feedback on assignments need to be submitted to a Tutor in a timely manner.

9. Updates
The Terms and Conditions may be updated from time to time. A new version will be circulated to the Client with the billing. Continuation of lessons implies acceptance of the updated Terms and Conditions.
